Terms & Conditions

1.    By booking a photoshoot with us, you acknowledge and agree to all terms as detailed below.

2.    The owner of the pet must attend all appointments and are responsible for payment of invoices.

3.    The session fee does not include digital files or print products unless otherwise stated. Digital files and print products are purchased at additional cost. New price system includes print credit.

4.    Appointment cancellation policy:
- If the photoshoot is cancelled within 3 days of the booking being made - 100% refund. 
- More than 48hrs before photoshoot, an $80 admin’ fee is retained and the balance refunded.
- Less than 48hrs from photoshoot, $180 fee is retained (equivalent to a session-only booking fee).
- Less than 24hrs cancellation for purchase appointments are charged an additional appointment fee.

5.    Purchase appointments:
- One purchase appointment is included as part of your booking fee.
- Purchase appointments must be booked within 30 days of the photoshoot and all orders are placed during this appointment so please ensure you have your budget and ideas ready!
- Images will be archived after your purchase appointment or 30 days after your photoshoot (whichever is first) and a fee will be required to retrieve them after this time.

6.    If your pet is dangerous or destructive to photographer, studio or others, then the photographer reserves the right to cease the photoshoot immediately. If your pet is uncooperative or has little or minimal training, you may be limited in your choice of photos.

7.    To avoid disruption during the photography session other photography, including video, by family/friends is not permitted. Please ask first, if possible I will make time at the end of the shoot for some “behind-the-scenes” photos.

8.    Taking copies of images shown during your purchase appointment (whether via online or in-person) is prohibited under copyright law and could incur legal action plus a $250 per image digital download fee. (See points 14-15.)

9.    Digital files:
- It is the responsibility of the client to store their own photos safely with appropriate backups (we recommend two locations as a minimum, e.g. external hard drive, cloud, computer hard-drive). Please remember computer storage devices do degrade and become out-of-date.
- Copies of raw and edited files are retained in my archives for one year after your photoshoot but any request for access to these archives (e.g. in the event of the loss of your own digital copies) will incur an admin fee. Please note I am now retiring my business so please do not rely on me as a backup. 

10.    Print products:
- Print products are delivered by courier direct to the address supplied by you in the questionnaire.
- Janine Fabre Photography guarantees any print products purchased through us.
- Any problems with the products (whether digital or print) must be brought to our attention within 48hrs of receipt of product.
- Damage in transit? Please take photos of damaged packaging before you open the box, as well as the damaged print/s and email photos to us immediately. Prints will be replaced at no charge. 

11.    Print and digital file order cancellations:
Any print order cancellations need to be made in writing within 3 days of order (prior to manufacture/printing) however editing fees of $25 per image are applied.  Outside of 3 days, all payments will be forfeited.
- Any reduction in your order may mean a reduction or cancellation of any additional incentives that were offered during the appointment (such as additional discounts, complimentary digital files or gift vouchers).
 
12.     Late payments will incur a late payment fee and/or cancellation of any complimentary offers such as referral gift vouchers, print credit or complimentary digital files.

13.     Editing - Excessive editing requests may be charged at an hourly rate.

14.     Janine Fabre retains copyright of all images. Any images posted on our social pages may be shared by you on your own social media (in fact we encourage it!) but images are not to be printed or the logo removed, and must be credited to Janine Fabre Photography in all instances.

15.    Digital files usage rights licence:
Any digital files purchased are licensed for personal use only and not to be on-sold or used for commercial purposes (this applies to any high or low resolution files supplied). 
- High resolution files can be reprinted but please be aware colour profiles vary between print labs and therefore there is no guarantee of colour reproduction or quality of print if you choose to print elsewhere.
- Social media (low resolution) files are for your own social media and the watermark is not to be removed. Please credit Janine Fabre Photography. You can also share these smaller files with your family but not to any commercial entity.
- Any and all commercial enquiries for access and use of digital files are to be referred to Janine Fabre Photography. 
- Images may not be used by clients for competitions, commercial marketing purposes, or as reference material for artworks.
- Commercial interests may include, but are not limited to, breeders, groomers, pet merchandise retailers, boarding kennels, trainers. They may contact us to purchase their own copies from us. They are strictly not to be given access to your copies of files.
- Commercial interests are welcome to share any posts made on social media provided they retain all watermarks and acknowledge Janine Fabre Photography as the source.
- If you, the client, has your own pet-related business, please chat with me first. I am generally very flexible and understanding but will provide appropriate guidelines.

16.    Image Use: 
- By confirming your session, you give Janine Fabre Photography the unrestricted right and permission to copyright and to use, re-use, publish, and republish the photographic pet portraits taken, through any and all media known for illustration, art, sale, promotion or advertising. 
- You relinquish any right to examine or approve the completed product or advertising copy or printed matter which may be used by other commercial businesses.


17.    Neither party shall be liable for any costs or damages due to delay or non-performance under this contract arising out of any cause or event beyond our control, including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, accident, work stoppage, pandemic, power or other mechanical failure, governmental action, or communication disruption.

18.    By booking a photoshoot with us, you acknowledge and agree to all terms detailed above.
